Terms of use

These terms apply when you download or play a Little Ark Games game. By playing, you agree to them. If you don't agree, please don't use the game.
1. Who we are
Little Ark Games (ABN 71 623 929 557) is a registered business name based in Victoria, Australia. You can reach us at support@littlearkgames.com.
2. Your licence to play
We give you a personal, non-transferable licence to download and play our games on devices you own or control, for your own non-commercial use. The app store you downloaded the game from may set extra conditions, which also apply.
3. Coins, boosters and other virtual items
- Coins, boosters, lives, Travel Pass rewards, bag styles, themes, souvenirs and other virtual items have no real-world value. You can't exchange them for money or sell or transfer them, except where the law says otherwise.
- You get a licence to use virtual items in the game. We may rebalance their prices, rewards or effects to keep the game working well.
- Virtual items are stored on your device. If you delete the game or its data, they may be lost. Items you bought for real money that are permanent, such as Remove ads, can be restored with Restore purchases.
4. Purchases
- In-app purchases are made through Apple or Google and are also covered by their terms. Prices are shown in the store and include any taxes, such as GST, that apply.
- The Travel Pass premium track lasts for the season shown in the game.
- Refund requests go through Apple or Google; see Support for how.
- Every pack shows exactly what it contains. Our games don't sell random rewards.
5. Ads
The games show ads, including optional rewarded videos. Ads are provided by third parties, and we're not responsible for what they advertise. See the privacy policy for your ad choices.
6. Playing fairly
Please don't cheat, hack, alter or copy the game, use bots or exploits, or interfere with ads or purchases, except where the law allows it. We may stop providing the game or rewards to anyone who does.
7. Our content
The games, their art, music, text and code belong to us or our licensors. These terms don't give you any rights in them beyond the licence to play.
8. Changes to the games
We update our games to add content, fix problems and improve them. Features can change, and we may eventually stop running a game. If we stop selling items you've paid for or end a game, we'll give reasonable notice in the game where we can.
9. Your rights under consumer law
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or other laws that can't be excluded, including the consumer guarantees. If you live outside Australia, you also keep any mandatory protections in the law where you live.
10. Limits on our responsibility
To the extent the law allows, the games are provided "as is", and we aren't liable for indirect or consequential loss, or for loss caused by things outside our control, such as your device, your internet connection or third-party services. Where the law lets us limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the service again or paying for it to be supplied again.
11. Ending these terms
You can stop at any time by deleting the game. We may suspend or end your access if you seriously breach these terms. Sections 3, 7, 9, 10 and 12 continue after these terms end.
12. Governing law
These terms are governed by the law of Victoria, Australia, and the courts there can hear disputes, without affecting any right you have to bring a claim where you live.
13. Changes to these terms
We may update these terms. We'll change the effective date above and, for significant changes, tell you in the game. If you keep playing after a change, the new terms apply.
